SEND Appeals At An All-time High
Unfortunately this year one of the most common trends we have seen within education is that there still needs to be more in place for SEND. Now, SEND tribunal appeals have reached an all-time high with almost 12,000 registered so far this year. Over 3,000 more than last year.
SEND Appeals
SEND appeals are when the parents or carers appeal against council refusals to assess a child’s needs or to issue an education, health and care plan (EHCP). 2021 to 2022 data from the Ministry of Justice (MoJ) shows 27% of appeals were against a council’s refusal to secure an assessment for a plan, while 54% were against the council’s choice of a school or college.
With more than half of appeals relating to the council’s choice of school or college, alarm bells have been raised over the efficiency of schools in providing adequate care for vulnerable children, such as those with Special Educational Needs and Disabilities. Adding fuel to the ongoing discussion that councils are not providing enough adequate SEND school places within their remit. Leading to them including inadequate schools within EHCPs.
Autism Emphasis
More than half of the appeals from 2022 have been in relation to Autism. Unfortunately, Autism is being flagged regularly as one of the most challenging needs to find a placement in a suitable school. This often leads to ill-equipped parents taking on full-time care and educational responsibilities within the home, with no respite.
Many schools currently employ Teaching Assistants who are more than capable of offering the additional support and care required. However, they would benefit from a further understanding and knowledge that they would gain from a qualification.
